Terms of Service - FIA Now Mobile Application

1. Acceptance of Terms

By downloading, installing, or using the FIA Now mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

FIA Now is a mobile application provided by Food Industry Asia ("FIA", "we", "us", or "our") that provides members with access to:

Industry updates and announcements
Regulatory documents and guidelines
Meeting schedules and consultations
Committee information and resources
Document library and downloads
Push notifications for important updates

3. Eligibility and Account Access

3.1 Membership Requirement

Access to FIA Now requires valid FIA membership. By using the App, you represent that:

You are an authorized member or representative of a member organization
You are at least 18 years of age
All information you provide is accurate and current

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying FIA immediately of any unauthorized use

4. License and Restrictions

4.1 Limited License

FIA grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

4.2 Restrictions

You may not:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Remove any copyright or proprietary notices
Use the App for any illegal purpose
Share your account credentials with unauthorized persons
Distribute or resell content obtained from the App
Use automated systems to access the App

5. Intellectual Property

5.1 Ownership

All content in the App, including but not limited to text, graphics, logos, documents, software, and data compilations, is the property of FIA or its content suppliers and is protected by international copyright laws.

5.2 Member Content

Content provided by FIA members remains the property of those members, subject to the license granted to FIA for distribution through the App.

6. User Conduct

You agree to:

Use the App only for lawful purposes
Respect the intellectual property rights of others
Not interfere with or disrupt the App's operation
Not attempt to gain unauthorized access to any systems
Comply with all applicable local, state, national, and international laws

7. Content and Information

7.1 Accuracy

While FIA strives to provide accurate and up-to-date information, we make no warranties regarding the accuracy, completeness, or reliability of any content in the App.

7.2 Regulatory Information

Regulatory documents and guidance are provided for informational purposes only and should not be considered as legal advice. Users should consult with qualified professionals for specific guidance.

7.3 Third-Party Content

The App may contain links to third-party websites or resources. FIA is not responsible for the content or practices of these third parties.

8. Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

9. Modifications to the Service

FIA reserves the right to:

Modify or discontinue the App at any time
Change features or functionality without notice
Update content and materials as needed
Impose limits on certain features or restrict access

10. Fees and Payment

Currently, the App is provided to FIA members at no additional charge beyond membership fees. FIA reserves the right to introduce fees for certain features in the future with advance notice.

11. Termination

11.1 By FIA

FIA may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including:

Breach of these Terms
Termination of FIA membership
Conduct harmful to other users or FIA
Legal or regulatory requirements

11.2 By User

You may stop using the App at any time by uninstalling it from your device.

11.3 Effect of Termination

Upon termination:

Your right to use the App ceases immediately
You must delete all copies of the App from your devices
Provisions of these Terms that by their nature should survive termination will survive

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
That the App will be uninterrupted, secure, or error-free
That defects will be corrected
That the App is free of viruses or other harmful components

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIA SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Service interruptions or data loss
Any damages arising from your use or inability to use the App

IN NO EVENT SHALL FIA'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO FIA IN THE TWELVE MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless FIA, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of another party
Any content you submit through the App

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

Good faith negotiations between the parties
If negotiations fail, through binding arbitration in Singapore in accordance with the Singapore International Arbitration Centre (SIAC) rules

16. General Provisions

16.1 Entire Agreement

These Terms constitute the entire agreement between you and FIA regarding the App and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 No Waiver

FIA's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without FIA's prior written consent. FIA may assign these Terms without restriction.

16.5 Force Majeure

FIA shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control.

17. Changes to Terms

FIA reserves the right to modify these Terms at any time. We will notify users of material changes through:

In-app notifications
Email to registered users
Updates on our website

Your continued use of the App after changes constitutes acceptance of the modified Terms.
